Lorsque votre \u0153uvre musicale est jou\u00e9e devant un public (tv, radio, num\u00e9rique, diffusion en continu, musique de fond, en direct, etc..), par vous ou par quelqu\u2019un d\u2019autre, vous avez obtenu une redevance d\u2019ex\u00e9cution publique.<\/span><\/p>\n<\/q><\/blockquote><div class=\"author\"><span class=\"company-name\"><strong> Loi sur le droit d'auteur<\/strong><\/span><\/div><\/div><\/div><\/div><div class=\"fusion-text fusion-text-2\"><p><span style=\"font-weight: 400;\">Lorsque nous parlons des parts de l\u2019auteur et de l\u2019\u00e9diteur, nous faisons r\u00e9f\u00e9rence \u00e0 la mani\u00e8re dont le droit d&rsquo;auteur est reconnu par la titularit\u00e9 d\u2019une \u0153uvre, de la composition musicale, autrement dit la partie \u00e9crite d&rsquo;une chanson (la partition).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lors de l\u2019administration de l\u2019\u00e9dition musicale, les parts sont traditionnellement divis\u00e9es \u00e0 50\/50 entre l&rsquo;auteur-compositeur et l&rsquo;\u00e9diteur. Par exemple, lorsqu&rsquo;une \u0153uvre musicale est ex\u00e9cut\u00e9e devant un public, jou\u00e9e \u00e0 la radio ou diffus\u00e9e en continu sur une plateforme de diffusion num\u00e9rique (DSP), les titulaires de droits (ayants droit) ont droit \u00e0 des redevances d&rsquo;ex\u00e9cution publique et \u00e0 des redevances de reproduction m\u00e9caniques*.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les droits d&rsquo;ex\u00e9cution sont administr\u00e9s par <a href=\"https:\/\/musicteam.com\/fr\/societes-de-gestion-collective-et-associations-musicales-quebec-canada\/\">les soci\u00e9t\u00e9s de gestion collective<\/a> (PROs), les droits de reproduction m\u00e9caniques par une PRO ou une CMO (<\/span><i><span style=\"font-weight: 400;\">Collective Management Organisation)<\/span><\/i><span style=\"font-weight: 400;\"> ou une MLC (<\/span><i><span style=\"font-weight: 400;\">Mechanical Rights Organisation).<\/span><\/i><span style=\"font-weight: 400;\"> L\u2019une des organisations mentionn\u00e9es repr\u00e9senterait aussi les droits num\u00e9riques (<\/span><i><span style=\"font-weight: 400;\">Digital Performance Rights<\/span><\/i><span style=\"font-weight: 400;\">). Dans certains cas, une organisation peut g\u00e9rer plus d&rsquo;un droit. Cela d\u00e9pend du pays et de la loi sur le droit d&rsquo;auteur de ce pays. Les soci\u00e9t\u00e9s sont charg\u00e9es d&rsquo;octroyer des licences, d&rsquo;assurer le suivi et de verser des <a href=\"https:\/\/musicteam.com\/fr\/metadonnees-droits-musicaux\/\" target=\"_blank\" rel=\"noopener\">redevances<\/a> aux auteurs-compositeurs et aux \u00e9diteurs de musique.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">*Le terme m\u00e9canique fait r\u00e9f\u00e9rence au processus utilis\u00e9 pour fixer la reproduction de l&rsquo;enregistrement sonore sur un support. Un parfait exemple de reproduction m\u00e9canique est celui d&rsquo;une \u0153uvre press\u00e9e sur un vinyle. De nos jours, nous avons tendance \u00e0 utiliser le terme droit de reproduction ou droit de reproduction m\u00e9canique au lieu de droit m\u00e9caniques en raison de la num\u00e9risation de l&rsquo;industrie musicale. Le processus de reproduction a \u00e9volu\u00e9 et l&rsquo;aspect m\u00e9canique de la reproduction est per\u00e7u diff\u00e9remment lors d&rsquo;une reproduction num\u00e9rique. Lorsqu&rsquo;elles ont \u00e9t\u00e9 invent\u00e9es dans les ann\u00e9es 1880, les partitions musicales pouvaient enfin \u00eatre reproduites m\u00e9caniquement.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Traditionnellement, l&rsquo;\u00e9dition musicale et son administration \u00e9taient g\u00e9r\u00e9es uniquement par les \u00e9diteurs. Pourquoi? Parce que poss\u00e9der une machine \u00e0 papier et une presse rotative n&rsquo;\u00e9tait accessible \u00e0 personne d&rsquo;autre que les d\u00e9cideurs (rois et gouvernements) et les membres de la presse.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">M\u00eame \u00e0 cette \u00e9poque, les \u00e9diteurs existaient depuis les ann\u00e9es 1500 (Ottaviano Petrucci) et la premi\u00e8re soci\u00e9t\u00e9 de gestion collective (PRO) a \u00e9t\u00e9 fond\u00e9e en 1777 \u00e0 la suite du premier acte du droit d&rsquo;auteur de 1709. <\/span><\/p>\n<\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-3 fusion_builder_column_1_2 1_2 fusion-flex-column\" style=\"--awb-bg-size:cover;--awb-width-large:50%;--awb-margin-top-large:0px;--awb-spacing-right-large:3.84%;--awb-margin-bottom-large:20px;--awb-spacing-left-large:3.84%;--awb-width-medium:100%;--awb-order-medium:0;--awb-spacing-right-medium:1.92%;--awb-spacing-left-medium:1.92%;--awb-width-small:100%;--awb-order-small:0;--awb-spacing-right-small:1.92%;--awb-spacing-left-small:1.92%;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-text fusion-text-4\"><p><span style=\"font-weight: 400;\">Les \u00e9diteurs ne se contentaient pas de reproduire et de publier les \u0153uvres, mais ils s&rsquo;occupaient \u00e9galement du commerce et de l&rsquo;importation\/exportation des partitions. Le concept de commercialisation ou de <a href=\"https:\/\/musicteam.com\/fr\/distribution-musicale\/\" target=\"_blank\" rel=\"noopener\">distribution de la musique<\/a> existait bien avant qu\u2019un enregistrement sonore puisse \u00eatre fix\u00e9 sur un support physique.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finalement, le phonographe et le gramophone sont arriv\u00e9s (1877 et 1893). Le fait est que l&rsquo;\u00e9volution technologique fait partie de l&rsquo;industrie de la musique depuis ses d\u00e9buts. Cela \u00e9tant dit, m\u00eame si les technologies et les outils num\u00e9riques ont \u00e9volu\u00e9, le mode de paiement des redevances d&rsquo;ex\u00e9cution publique reste inchang\u00e9.
